PLEASE READ THESE TERMS OF SERVICE CAREFULLY. THIS AGREEMENT CONTAINS DISPUTE RESOLUTION PROVISIONS IN SECTION 14 AND SECTION 15 THAT GOVERN ANY DISPUTES BETWEEN YOU AND OUR OPERATING ENTITY.

These Terms of Service ("Terms", "Agreement") govern your access to and use of the website (claylia.com), products, DIY crafting kits, tutorial materials, and related services (collectively, the "Services") operated and provided by PINHENG CORE ENERGY TECHNOLOGY (HONGKONG) CO., LIMITED ("Claylia," "we," "us," or "our").

By browsing, accessing, or placing an order through the website, you agree to be bound by these Terms and our incorporated policies, including our Privacy Policy, Refund & Return Policy, Shipping Policy, and Warranty Policy.

2. Crafting Products & Safe Use Disclaimer

Claylia craft products (including 52-color air-dry clay, stone-plastic clay, gypsum plaster powder, pigments, and sculpting tools) are intended for artistic, hobby, and decorative craft applications only:

  • Not Food Safe: Cured or uncured clay and plaster items are not intended for direct food contact, microwave, oven, or dishwasher use.
  • Choking Hazard & Small Parts: Certain sculpting tool sets, tiny accessories, and craft components may pose a choking hazard. Adult supervision is required when children are crafting.
  • Proper Storage & Handling: Air-dry clays will naturally harden if exposed to air. Store unsealed materials in airtight containers in a cool, dry place. Avoid contact with eyes or open wounds; wash hands thoroughly after crafting.

3. Orders, Pricing, and Fraud Screening

  • Order Acceptance: Receiving an electronic order confirmation does not signify our final acceptance of your order. We reserve the right to accept, decline, limit, or cancel quantities purchased per person, household, or order at our sole discretion.
  • Reseller Prohibitions: We do not permit orders placed by unauthorized dealers, wholesalers, or bulk resellers without prior written agreement.
  • Pricing & Errors: While we strive for absolute accuracy, typographical errors in product pricing or descriptions may occur. In the event of an obvious mispricing error, Claylia reserves the right to correct the error and cancel the order prior to shipment with a full refund.
  • Payment Processing: Transactions are processed via Airwallex and verified third-party payment gateways (e.g., Credit Cards, PayPal, Apple Pay). All billing information must match bank records.

4. Shipping, Returns, and Guarantees

All purchases are subject to our standalone operational policies:

  • Shipping: Deliveries and transit timelines are governed by our Shipping Policy.
  • Returns & Refunds: Standard 30-day return procedures, eligibility, and restocking conditions are governed by our Refund & Return Policy.
  • Quality Guarantee: Tool replacements and material freshness terms are governed by our Warranty Policy.

5. User Accounts & Security

If you register for an account on our store, you are responsible for maintaining the confidentiality of your username, password, and account credentials. You agree to accept full responsibility for all activities that occur under your account. Notify us immediately at support@claylia.com if you suspect any unauthorized account access.

6. Intellectual Property Rights

All content available across the Services—including brand names, logos, original craft designs, kit concepts, text, photos, video tutorials, software scripts, and visual aesthetics—is the exclusive intellectual property of PINHENG CORE ENERGY TECHNOLOGY (HONGKONG) CO., LIMITED or its licensors and is protected by applicable copyright and trademark laws. You are granted a limited, personal, revocable license to access content for personal, non-commercial crafting use only.

7. User-Generated Content & Reviews

If you submit product reviews, craft photos, project videos, testimonials, or suggestions ("User-Generated Content") to Claylia:

  • You grant Claylia a perpetual, royalty-free, worldwide, non-exclusive, sublicensable license to use, reproduce, display, edit, and publish your content across our website, marketing channels, and social media.
  • You warrant that you own or have obtained all necessary permissions for the submitted media, and that it does not infringe upon any third party’s intellectual property or privacy rights.

8. DMCA / Intellectual Property Infringement Notice

Claylia respects the intellectual property of others. If you believe your copyrighted work has been infringed on our website, please send a written notice to our designated agent at support@claylia.com with the subject line "IP Infringement Notice", including the location of the infringing material, proof of ownership, and your contact details.

9. Third-Party Tools & External Links

We may provide access to third-party tools, plugins, or external web links (e.g., parcel tracking portals, social media platforms). We do not control or endorse external content and are not liable for any harm, damages, or privacy practices arising from third-party websites or services.

10. Prohibited Website Activities

You agree not to: (a) scrape, crawl, spider, or harvest data from the Services using automated means; (b) circumvent or compromise security features; (c) post abusive, discriminatory, harassing, or defamatory statements; or (d) use our products or site for fraudulent activities.

11. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES AND ALL PRODUCTS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. 12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PINHENG CORE ENERGY TECHNOLOGY (HONGKONG) CO., LIMITED, ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES (INCLUDING LOSS OF PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION) ARISING OUT OF OR IN CONNECTION WITH THE USE OF OUR PRODUCTS OR WEBSITE.

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE TOTAL AMOUNT ACTUALLY PAID BY YOU FOR THE SPECIFIC ORDER OR PRODUCT GIVING RISE TO THE CLAIM.

13. Indemnification

You agree to indemnify, defend, and hold harmless PINHENG CORE ENERGY TECHNOLOGY (HONGKONG) CO., LIMITED, its officers, directors, employees, and agents from and against any third-party claims, liabilities, damages, losses, and legal expenses arising out of your misuse of our products, breach of these Terms, or violation of any applicable law or third-party right.

14. Dispute Resolution

  • Informal Resolution: In the event of any dispute or claim arising from your purchase or use of the Services, you agree to first contact support@claylia.com to seek an informal resolution within 30 days before initiating formal legal proceedings.
  • Jurisdiction: Any legal dispute, controversy, or claim arising out of or relating to these Terms shall be settled amicably, failing which it shall be submitted to the competent courts of Hong Kong Special Administrative Region (SAR).

15. Governing Law

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Hong Kong SAR, without regard to its conflict of law principles.

16. Severability & Entire Agreement

If any provision of these Terms is deemed unlawful, void, or unenforceable, that provision shall be severed and shall not affect the validity and enforceability of any remaining provisions. These Terms constitute the complete understanding between you and PINHENG CORE ENERGY TECHNOLOGY (HONGKONG) CO., LIMITED regarding the Services.

We reserve the right to revise or update these Terms at any time by posting the updated version on our website. The "Last Updated" date at the top indicates when modifications took effect. Your continued use of the website following changes constitutes acceptance of the updated Terms.
